Off‑Plan Property in Phuket 2026: Payment Plans, Risks & Checklist

Independent guide from a buyer-side broker. No project promotion — just what you need to evaluate, negotiate, and protect yourself when buying off-plan in Phuket.

Why this guide? Most off-plan content in Phuket is written by developers or their agents — who profit when you buy. As an independent buyer-side broker with 150+ closed transactions, we've seen buyers lose deposits, wait five years for unfinished units, and sign contracts with zero exit protection. This guide reflects what actually goes wrong.

Typical Payment Schedules in Phuket 2026

Payment plans vary widely. Here are the most common structures — and what each signals about risk level.

PlanBookingDuring constructionOn handover
10/20/7010%20% (2–3 milestones)70%
30/7030%—70%
20/8020%—80%
10/10/10/10/6010%30% (3 milestones)60%
50/5050%—50%

Each installment should trigger on a verifiable construction event (foundation complete, slab poured, roofing, fit-out). Never pay a milestone without an independent inspection confirming the work. The contract must specify a penalty if the developer misses a milestone by more than 3–6 months.

10 Red Flags When Buying Off-Plan in Phuket

Any one of these should pause your decision. Multiple flags = walk away.

1

No EIA approval — or developer refuses to provide it

2

Cannot verify Chanote (Nor Sor 4 Jor) title at the Land Department

3

"Guaranteed" rental yield with no legal contract backing it

4

No escrow or custodian account — funds go directly to developer

5

Pre-launch price 30–40%+ below comparable ready units

6

Developer's first project with no completed track record

7

Rushed signing pressure — "price goes up tomorrow"

8

Vague completion date with no delay penalty clause in the contract

9

Foreign ownership condo quota already exceeded or not disclosed

10

No exit or refund clause if developer defaults or delays >12 months

Off-Plan vs Resale: Side-by-Side Comparison

Neither is universally better — it depends on your timeline, risk tolerance, and goals.

Can You Sell Before Completion? (Assignment)

Yes — selling your contract before handover is called assignment. In Phuket this has become a liquid sub-market, particularly for branded developments and prime beach locations.

The best window is typically 18–24 months after launch, when construction is visible and a new price list is 15–25% higher than your entry price.

  • Developer consent is usually required — get it in writing at contract stage
  • Assignment fee: 1–3% charged by some developers
  • Capital gains: progressive withholding tax applies on profit
  • If reselling at a loss: consult a tax lawyer on the treatment

Due Diligence Documents Checklist

Chanote (Nor Sor 4 Jor)

The only title deed that allows full transfer and mortgage. Reject Nor Sor 3 or Sor Kor 1 outright.

EIA Approval Certificate

Required for projects >80 units or in coastal zones. Request the official Ministry document, not a screenshot.

Building Permit (Sor Por 6)

Confirms footprint and floors are legally approved. Compare to the architect's plans.

Developer Company Registration

Verify registered capital, directors, and shareholders at DBD (Department of Business Development).

Escrow / Bank Guarantee Agreement

Confirms your staged payments are protected. Ask which licensed bank holds the account.

Foreign Quota Certificate (condo)

Verify available units under the 49% foreign quota — request from the juristic person.

Construction Warranty Clause

Minimum 1-year structural + 1-year fit-out warranty. Must be in the sale contract.

Tax Clearance at Land Office

Confirms no outstanding land tax. Required at transfer registration.
